A federal judge in Florida has ruled that the president’s health care overhaul, “Obamacare,” is unconstitutional. The judge based his ruling on the law’s mandate that citizens must purchase health care, a requirement he said violates the Constitution. The ruling affects the 26 states who had joined together to file a case against the law, but also has implications for the entire country. U.S. District Judge Roger Vinson ruled Congress overstepped its bounds by instituting the individual mandate, but also said the entire law was unconstitutional since the individual mandate is not “severable,” Fox News reports. Judge Uses Obama's Words's Against Him - Washington Times - In ruling against President Obama‘s health care law, federal Judge Roger Vinson used Mr. Obama‘s own position from the 2008 campaign against him, when the then-Illinois senator argued there were other ways to achieve reform short of requiring every American to purchase insurance.  “I note that in 2008, then-Senator Obama supported a health care reform proposal that did not include an individual mandate because he was at that time strongly opposed to the idea, stating that, ‘If a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house,’” Judge Vinson wrote in a footnote toward the end of his 78-page ruling Monday.  Read more......  Article contributed by Steve Peters.

Florida Judge Strikes Down Health Overhaul - Newsmax - A federal judge ruled Monday that the Obama administration's health care overhaul is unconstitutional, siding with 26 states that sued to block it. U.S. District Judge Roger Vinson accepted without trial the states' argument that the new law violates people's rights by forcing them to buy health insurance by 2014 or face penalties.  Attorneys for the administration had argued that the states did not have standing to challenge the law and that the case should be dismissed.  The next stop is likely the U.S. Supreme Court. Two other federal judges have upheld the insurance requirement, but a federal judge in Virginia also ruled the insurance provision violates the Constitution.  In his ruling, Vinson went further than the Virginia judge and declared the entire health care law unconstitutional.  Read more........

Yeah Nancy Pelosi was right...."We have to pass the bill so you can find out what is in it." Now two Federal courtshave finally done just that, read the whole law and found it to be well beyond the limits of the US Constitution. Health Reform's Politica Fallout  - Pat Caddell  and Doug Schoen - Politico - Despite talk earlier this week that the health care law was gaining favorability in the wake of the House repeal effort, polls now show it continues to be unpopular among a majority of the American public.  Indeed, directly after the House voted to repeal, a few polls showed slight upticks in favorability. But whatever ground the health care law appeared to have gained proved fleeting. A poll released Tuesday by the Kaiser Family Foundation and the Harvard School of Public Health shows the law remains unpopular — with 50 percent of respondents viewing it unfavorably, up 9 percentage points from the last survey.  Read more....... Democrats should read this and weep. The repercussions that HAVE occurred and will continue to occur to their party because of all the lies and deceit used to pass the ObamaCare bill into law are going to be profound.
